Just to give this one some closure, here's the letter I sent to the shop;
RE: Fox Float R Shock Absorber Eyelet Bushes Work – 30/06/2017
Dear Mark Hartley,
As already discussed in person, I am not happy with the damage that has been sustained by my Shock Absorber whilst in your care during the installation of new eyelet bushes. There is damage to the shock body from being clamped in a vice which, referencing the Fox guide for this job, should not have been done. (Please find the guide enclosed). There are also 2 gouges in the shock body and the new eyelet bushes that have been installed are warped as if they have been impacted or over-pressed.
The Consumer Rights Act 2015 states that “reasonable care and skill must be used whilst working”. In my opinion, whoever has carried out the work has not used reasonable care and skill as can be seen in the pictures. I have also enclosed pictures of my shock absorber the day before it was dropped into your shop for work which shows that there was no damage previously.
Although you have made claims that the damage does not affect the performance of the shock absorber, I’m still not happy with the aesthetics of it now that it has been damaged and will not accept the original item back in its current state.
I ask that you either replace the shock absorber completely or have the shock absorber repaired by Mojo Suspension. I have been in contact with Mojo and spoken to Adrian who has advised me that the performance of the shock absorber will not be affected however there is still the issue of the aesthetic damage. Adrian advised that if that repair had been carried out by a technician at Mojo, it wouldn’t have been returned to the customer and a new one would have been sent out. Although Adrian was reluctant to send any communication back to me condemning the work due to being a distributor, I have recorded the phone call should I need to use this in my legal defence.
Mojo have estimated that for new eyelet bushes, a new anodised body and a service, the repair would amount to £115.
Please contact me as soon as possible, no later than 14 days from the date of this letter, to agree a date by which you propose to resolve this.
If I do not hear back from you in the time suggested above, I will be taking further legal action as advised by my solicitor.
