chaps, i'm all in a flap!

basically, i have an issue with the owner of the house that sits the other side of our shared driveway. the hosue is up for LET, and he is telling the people who come to look, that the drive is his, and we have access.

as far as I know, it is actually OURS, as in SHARED. I need to set him straight, buti need to get my facts straight.

What should my course of action be???
 
get a copy of the deeds from your solicitor ...... and photocopy it so you can accidently put a copy through next doors letterbox ,




or...... me and sheila could move in lol
 
A few years ago we were able to download a copy of our deeds and our heighbours deeds from Land Registry for a only a minimal cost. Do that and take a look, if you still can't get it sorted go to a solicitor and get it sorted once and for all. That idiot has made your life misserable before and I reckon he will carry on doing it time and time again. I know a solicotor will cost you but you'll know for certain where you both stand mate. Start with land registry and go from there, we sorted a problem out with some old neighbours by just getting all the deeds for the block of 4 houses.

The land registry and solicitors bit lost me, the deeds to my house were in an asda bag under the bed in the spare room, we cleared it out a couple of years back and put then somewhere safe. I haven't seen them since :nenau

You may be alble to check yours and next doors deeds on the internet for a small fee, however not all properties are on the land register it depends when they were last bought and sold. My property is the only one not register in the road, but my deeds are I hope safley in the bank were I put them some years ago.

If it is shared drive is it not right that you both have the rights to pass over but not park or block the drive.

I do have the deeds, always have, and i have, believe it or not, always been pretty clear about the boundaries. Basically, its a shared driveway. My deeds show my original land boundaries, and the new ones as laid out by the new driveway, and it does say, in pretty plain english, that I have ROW over the red section, and they have ROW over the green section. RED being their part of the land, GREEN being mine. its pretty idiot proof, its NOT HIS driveway, thats that, but he is claiming time and again that it is, and im fed up of it. Got solicitors ringing me back Monday, based on that, I will send the guy a copy of my proof that this land is infact both of ours, and shared, and that he has built on it when the deeds say this is not alloweed (he has tarmacced HALF the drive) PLUS, he has build on "our" land with tarmac. I am going to suggest very strognly that I have had enough, i am going to seek advice re having the tarmac removed and the drive restored back to how it is set out in the deeds, at his expense, or i want the aggrement retracted, and the land split apart.

I know for a fact he will be a cock, and he will be difficult, and he will threaten me and be an arse, but i have had enough now, he is essentially stealing form us and laughing at us as he does it, this isnt on.

i hate this sort of thing, but i am going to stand up to him and fight my corner and sort this out once and for all.
 
i just bought from the land registry. well, if thats all he has, then he has certainly taken the piss big time. i have a shed load more deed information, but he does have a section outlining the shared drive and that both parties have ROW as I have described. I am wondering if he DOESNT have the information I do, i.e. the boundary measurements etc? if that is the case, i am going to come down on him like a ton of bricks.

correct Bri, and i will admit to parking on it to load/unload, as does he, only it is he who has threatened me over doing this, which just isnt right. basically, he treats it as HIS drive, and acts like he is doign me a favour, by moving off it so i can park my car. its totally wrong.
 
Clivvy mate, the bloke is a bully as we've said before so may not be a good idea to challenge him yourself. Did you say that you've now got a copy of his deeds from the land registry? good move as you can see what he should have but don't tell him. It'll cost you but far safer in the long run and also you can not easily sell the house with a cloud hanging over this issue so it needs sorting once and for all.
Go to a solicitor and give him copies of both sets of deeds, retain a copy for your self. Explain that the man has been unreasonable in the past and let the solicitor run with it. It may simply be a solicitors letter to do the trick or it may be a little trickier and even involve a court case at it's extreme which may well involve surveyors. All this could cost money that you may never get back but look at it another way that you'll get peace of mind and be able to sell the house when ever the need arises with a clean slate and no come backs on you. Also get the solicitor to the agency that handles the rental of the property too as they should be made aware officialy that there is a dispute between the both of you.
Also keep a diary of any communications between the both of you, if he starts threatening you contact the police and also make it known to the solicitor as it will surely be amunition.

Get it sorted Clive and let the solicitor have all the stress. You can't sort this on your own Clivvy and it'll make you ill mate.
 
thanks for that JIm, ill try do what you suggest. My home insurance provides free legal advice, so the solicitors are ringing me back MOnday. Ill speak to them in more detail, and send them a copy of the deeds I have, and hopefully, my insurance will cover any costs if I have a case-but at least the advice is free.

ill take it from there, but i msick and tired of this bullshit. Im sick and tired of people like him, trying to bully ans steal from people like me. Im going to show him how strong i can be, starting with a simple letter putting the deed dispute in order. If he comes knocking, im just gonna call the police after slamming the door in his face.

If I am lucky, it wont come to anything more than him backing off. If he gets pissy about anything with the driveway, I have a lot of ammo to be pissy right back, so we can go all day with pissy arguments, this is one i am fairly confident he cant win, not in terms of the driveway becoming his property, that simply will not happen.

cheers Rick, thats the plan. Im 99% sure he will come knocking. he is a money grabbing pratt, he wont want to get solicitors involved even though the last time we spoke he was saying he had spoken to his solicitor (i think he bullshits) so I am hoping a good letter, outlining the evidence i have in my deeds will be enough. To be honest, if his argument is that the driveway is his, I have very good prospects in terms of winning that case, making him liable for all costs, which will probably be around £60k if it gets pissy.

All I know is, the land is shared and comprises my land and his land, and its as simple as that. PLus, the funny thing is, If it was his driveway, he would not have tarmacced half of it....
 
yes stick with it, it is a common problem with shared ownership, and the only way to sort it is through the courts if necessary, and as you say this can get expensive but do not lower yourself to his level and have a slanging match, keep calm and be positive "I do not wish to discus this matter with you my solicitor is dealing with it" say no more, Rick

If he tried to get a Solicitor the would check first and then Fob him off !

What if you built a 6"-9" high wall down the middle, on your side of course, your Terrano could drive over it with the ground clearance, but a car couldn't.:lol:lol
