I think i will phone tomorrow and say i want my deposit back unless he puts a new mot on it and if it passes without anything needed doing then i will offer to pay the mot fee.
If i can buy it with a new mot i could then pass it over to my usual garage that i trust to give it a good looking over and if there are any major problems i can contact the dealer as it dose come with a 3 month warranty and they would be obliged to repair it. Or if they refuse i could then take legal action. I understand my rights as the buyer and i don't give up on such things.
If this sounds like a bad idea the please tell me. It all depends if the trader will do the mot or not. If he point blank refuses i will know to walk away for sure.
I will look into the 2.7 but having a 2800kg braked towing limit it might be cutting it a bit fine.

travelling back and forth 2 hours for warranty fixes. Better off looking a little closer to home I think

Just thought i would mention that i am very thankful for the all the advice i have received. I hope it works out for me as this forum seems like a friendly place and im sure if i do buy it i will become a regular visitor.
I wish buying vehicles was simple. I have owned over 14 different vehicles since i passed my driving test at 17 and only 2 of these have been really really good buys. One being my first car a E reg fiesta that was absolutely mint form being i a pensioners garage most its life and a pug 306 that had a full dealers service history and one owner from new. Sadly both these cars were written off in accidents. The fiesta by my brother and the pug by myself. All the other car/vans i have owned have had major/minor problems. I don't think i am meant to have nice reliable transport. Perhaps i should bite the bullet one day and get something new or just revert back to owning a horse!

I've had some right sheds :D but a few minters.

When I was younger and in the motor trade I swaped my car every few months, always trading and swapping hot hatches and stuff.

Had a beautiful 3yr old mk3 golf gti but I let an ex keep that when we split ffs. Had an immaculate Clio 172 a few years ago, but tbh one of the best was back in the late 90's when I swapped a knackered mk2 xr2 for an immaculate Capri 2.0s, the Capri had 2 owners 70k up it and drove like it had just left the showroom, it lasted 3 months until I lost it drifting it around this long 70 mph bend on a frosty night and clipped the kerb snapping the half shaft and smashing the wheel into the inner arch, splitting the tank and god knows what else. I was a young idiot then but that's my biggest car related fk up seriously regret smashing that up :doh

Tbh tho I do LOVE my Terrano. Mrs thinks I'm a right sad twat, I just love to get in it and drive it at any opportunity :D proper makes me happy

ive had a 3L swb and mine was GOOD :D BUT that does mean yours will be :nenau

many of the members on here know alot about terranos more than i do :thumbs

PLEASE LISTEN TO THEM !!!! YOU WONT REGRET IT :thumb2

I now have a 2.7 swb and can honestly say its just as good as the 3L :clap

and like everbody on here i sure your MONEY is harded earned ???

DONT BLOW IT :sly

Tbh tho I do LOVE my Terrano. Mrs thinks I'm a right sad twat,

YOUR WIFE KNOWS YOU SO WELL ....................LOL :lol:lol:lol:lol

Deffinately dont want a 3.0 for a work horse, also a caravan pulling chap i know with a 3.0 said he has to go everywhere in 4th gear when towing with his 3.0 as the gearing is all to cock compared to his old 2.7:nenau

Sorry, I don't agree, I had a 2.7 for many years and can say, the 3.0l I have is better at towing my caravan than the 2.7 I had, also better on fuel, I know you 2.7 boys can put veg oil in, but the price of that's starting to rise.:augie

We have a contractor that runs a couple of 3.0l's for work horses and he loves them, you will get good and bad in all vehicles.
Just my opinion

Go, ask for the deposit back because it hasn't got a full years MOT as advertised and walk out. If he's that confident he can sell it he'll let you go and maybe he will find someone who doesn't care so much. Equally likely that handing back the deposit will be harder for him to actually do and he'll cave.

As has been said already, they're not so rare and for the money, there's been some lovely examples offered on here before.

I got my 1996 2.7Td off ebay in January for £800 - first time I've ever bought a car like that, but I figured it was worth a punt given it had a full MOT. Maybe you could pick up a cheap 2.7 swb initially until you find what you want?

The Law is a bit skitish But you will need a Tachograph and an operator license if the combined weight is over 3.5T now. I don't know if you have found a loophole like the farmers did, but this is now on all vehicles.

See below.

Where it says Commercial carriage of goods, what it means is, if you can make money out of what you are carrying then its commercial. So if its a lawn mower and you use it to cut other peoples grass for a living, that counts. If its your lawn mower and you only cut your grass its does not count.

VOSA have been seen to stop horse box's and claim that due to the fact that entering a competition where money or a prize is offed, then that is classed as commercial as well, even if its your own horse and your doing it for fun. :doh

I bought my 2.7TD Terrano 3 years ago from a local used car "Arthur Daley" type place (operated from the side of a filling station, office was a caravan) not a place to inspire confidence!
After having a look round it I had a word with the local garage that does my MOT's, asking them if they would look it over, to which they agreed.
I then went back to "Arthur Daley" and asked if I could take the T2 for a test drive, leaving the keys to my (company) Zafira as surety.
Zoomed straight down to MOT place, up on the ramp where they spent 20 mins looking over it - they then gave me a list of all that needed doing, then the best bit - NO CHARGE! - just keep coming back to us for your Mot's and work they said.
Back to the sales place where I showed them the list, no problem they said, but the four tyres that were needed would have to be second hand, or they would fit new if I was prepared to pay £100 towards the cost, not a problem for me, after all the car was only priced at £1500.
They stuck to their word and did it all - that car took me to Spain 5 months later and has covered around 22,000 since purchase, all on the extremely variable Spanish roads and tracks. When me and 'er indoors are in Spain it's our every day transport and when we're not it's my daughter's every day transport (she lives in Spain).
If you are set on the 3.0 perhaps you could try something similar if you know a friendly garage that does MOT's that would look it over for you.
When I took it for the "test drive" I didn't tell the sales place I was going to take it to be checked out, however, they did express some surprise that my test drive took three hours!

Ok so an update on my situation.
Its currently the same. Had a busy day at work today so didn't get chance to call the dealer until around 5pm but got a partner of the dealership instead. Had a short chat with him and said if it was down to him i wouldn't get my deposit back at all! However he said if it was his partner who was doing the deal i could take it up with him but will have to call back tomorrow.
I didn't suggest to pay for the mot and the mot only as i suddenly thought why have they not suggested this themselves as being the garage themselves to do it, it would only really cost them the time in labor unless perhaps they know it will need work doing.
I was told that because i agreed to pick it up the weekend after, this basically meant i was saying i would have it as it is with a short mot. I think we definitely had a misunderstanding here.
I really do not like the attitude of this dealership. I almost felt like it was me being an awkward customer the way they come across and being a 2 hour drive away i am not sure i would want to deal with them again if i did buy and then needed work doing under the warranty.
I feel i should if buying from a dealer look much closer to home and just be patient until something good turns up. Trouble is i could do with one by the end of next week.
On my way back from site today i pulled over to look at a 99 daihatsu fourtrack being sold privately. Its in very good condition for its age and has a towing capacity of 3500kg. I understand these are very reliable but more geared for off-road then on-road use and i wanted a good combination of both that you get with the terranos. I realize this is a Nissan forum so i don't expect many thoughts but it seems a good price and definitely comes with a full mot!

I will look into the tachograph issue about the towing i will be doing as i have been employed in the past and have towed a tracked chipper on a trailor with a landy and a hilux and never used a tacho so i have just assumed you didn't need one. It was for a large well established company that i still sometimes sub-contract for and their employees still drive the same setup without a tacho.

Looking at that chart kamsin. Im not sure i would need a tacho as it says its for hire or reward or commercial goods. I would be simply transporting tools/equipment for my own use.
I don't think i have every known a tree surgeon to use a tacho and towing trailers full of logs is very common in the trade and i imagine this would be even heavier the a tracked chipper on a trailer. Either that or lots and lots of tree men break the law every day!
I will still look into it more fully though just to be sure so thanks for the heads up.

yes I would go with that, commercial goods are goods for sale, Rick

Im not going to get into an argument about it, but the quote "For hire or REWARD" meaning if you get a reward for what ever your transporting. A quick call to VOSA and explian what it is your doing in detail will answer the question.

The people using a horse box arnt selling the horse they just enter a compertition "REWARD" and they are getting into trouble for it.

Its your call, but i do this for a living and thought id give you a heads up.

I know this may look a bit "Oh we have pxssed him off" but its not, its just the laws have changed and some people dont understand them and are thinking they are still ok when they are not.

You maybe ok, but the wording is confusing and i would not like to think i have let a member of our fourm get into trouble for not pointing it out.

I deal with LGV Law and dont concern myself with smaller vans on your kind of work but i thought it worth pointing out.

Even the wording "commercial goods" as solorman pointed out does not mean the goods them selves need to be sold, just they can be used to earn money. It used to be called "Profit or reward"

Again like i said its a heads up and hope it wont effect you. :thumbs

The govenment do this just to anoy me cos i have to learn the new laws and keep ahead of the game. :doh

Ok, im now starting to look like a right mardy bugger now. :lol

History will tell you that when a society/civilisation is failing the members in control introduce new laws by the dozen in order to try to rectify the situation, this never works as already the populace do not give a sh*t, and as there is no effective remedy for transgression, it just gets worse, this is about where we are now, the law is in effect unenforceable, unless it is about a parking fine or other easy to enforce scam against the motorist, Rick

I think you are making good valid points. I am a member of a tree surgeon forum called arbtalk and have been searching through to research what others have said and it seems like it is a very grey area. I cant see where one person actually has a tacho fitted but people have definitely been warned for not having one by either vosa or the police.
I am still under the impression that under 3500kg being towed should be ok if driven under 50 kilometers from your home but it dose not seem very clear at all.
I will look into more for sure as i like to be legal. Thanks

If it stays under 3500 its not always ok because then they get you with the trailer weight not being over 1,020 kilo. So if the towing vehicle is 2,000 and the trailer is 1,025 = 3,025 kilo they got you. It really is a mine field.

If the vehicle is over 3.5t gross (3.5 plated weight transit van) then any trailer is Tacho even a small one. :doh

Welcome to my world and my boss is always asking why im always on the phone....:lol
