Dealer first, I'd ask for money back and to keep the car at least. If they mot'd it I'd blackmail the f#ckers. I bought a car and discovered it had been clocked, so got proof and took it back telling them I wanted full refund or another car worth twice as much! Settled for 1 and half the price and didn't take it any further.
Do feel a little guilty that they could of stitched others up but it was good for me at the time. :-SS

Just for information guys, the mileage does not have to be taken from the tested car for an MOT . So is not the g/tee you think for confirming car mileage.

I think it illustrates the weakness of the English MOT system. Over here in N.Ireland, we have government centres with state of the art testing equipment. The testers are well trained and have no interest in failing a vehicle in order to do remedial work. Its a very straight system. I believe it was introduced many years ago as the template for what was going to be rolled out across the UK, but the government of the time decided not to bother. Probably would have upset too many of their party donors who run vehicle testing businesses.

the warrant of fitness system in new zealand is performed one of three ways.

VTNZ (vehicle testing new zealand) and VINZ (vehicle inspections new zealand) these two company's are testing stations staffed only with inspectors with a background in engineering, motorsport or mechanical who are regulalry scrutineered by the government

The third is by a general automotive workshop of your choice who employs an inspector who is approved by the government, but once again spot checks are done by the government with way of a secret shopper type thing were they will deliberately take a faulty car into random garages and see if the inspector is doing there job properly.

Also cars imported to NZ must have no rust or no evidence of repairs.

the result deceiving customs over said damage can be having the car destroyed by customs

you may import it but it can never be made road legal.in other words a wrecker.

cars here require this inspection once a year for the first 5 years then every 6 months after that.

Hi chaps - the car is being put through a government centre MOT tomorrow. I want to get an official report on its roadworthiness and then I will know where I stand. The dealer I bought the car from got it at an auction after the MOT had been granted a few days earlier. Both he and I have been unlucky.

This trail will lead back to the dodgy MOT garage and the previous owner. I'll put some pictures of the car up later. It looks terrific. The nicest one I had seen and I've been looking for some time.

Full Nissan service history every 6000 miles and low mileage. Underneath its just a bag of spanners. No mention of rust in any of the previous MOTs.

Your contract is with the seller you bought from, still pursue him (ignorance is no defence in law), the seller should have checked over the vehicle before selling it to you. Will be interesting to see what you MOT centre says, as said photee's please

+1 TBH all blame stops at the sellers door as he has sold a vehicle which isn't fit for purpose. by all means have it checked over & you should have a lot more info to hit the seller with & get your hard earned money back. The test centre may not allow it to be driven on the road in which case i'd get the seller to collect it from the test centre:augie

Here in Bristol the local council have their own garage where they MOT all their own vehicles. This facility is open to the public too, and because they have no interest in failing vehicles to create work, a fairer test is done. I only found out about this recently, and my next MOT (on a Honda Jazz, not my Terrano) in June will be done there.

My last one, done at a garage I have used for years, gave me a failure on headlights out of adjustment and poor handbrake. Had the car four years and the headlights have never been touched but suddenly both of them are out of adjustment and by the same amount! Told them to sort the handbrake and adjust the headlights - what did they do? Fitted new rear discs (I asked for the old ones back, they told me they had been binned!
I asked the receptionist where the scrap stuff went, she told me "The skip outside". Found them - nothing wrong with them, the car has only done 50K and the handbrake is no different, neither are the headlights).

Since found out the garage had changed hands shortly before my car went in - say no more! Robbing bar stewards!

I've bought loads of cars at auction not 1has had any warranty some are sold with no major mechanical faults but not that many as they have to be inspected by an engineer first. The only come back at auction is if they have been written off or have outstanding finance owing

the auction houses around here give 30 day rtn warranty on cars over £1k, under a grand they are either sold with known faults or no warranty implied. i have bought lots over the years to sell on when i have needed holiday money. that said, i have not purchased from oggies after 2008, cheers.

What is that auction company worth looking into ive never heard of anything like that.Who underwrites something like that

it was mainly bca walsall, but i did used to use the one in darlaston too. i see they only underwrite there own inspected cars now to a 500 mile warranty.

Get mot history online see if it failed on rust previously, then straight to vosa without touching anything

cnc i stand corrected, i was just having a doze and recall the cars over £1k had a 24hr window to return if major faults found if they were sold as no major faults, sorry to confuse the issue :augie
