Be careful Pete, lots of advice here but at the end of the day you have a motor worth what? a grand maybe grand and half, if repairs cost over the grand then it will be written off end of sally, so first things first we have no real idea of Sally's condition, so she needs to go to a proper vehicle alignment station to check that out, if the chassis is out, go get another motor end of story, all the talking under the sun is not going to make one bit of difference to that, if the chassis is OK then maybe, but dont expect a new rear bumper and new rear door cos those two items alone from Nissan put you over the grand without labour, you have to be realistic here I do not want to be negative but this is how it is, Rick
 
that is the key. you cannot reasonably expect refurbishment to a brand new standard. that is unrealistic.

its down to sensible negotiation between all parties. shy kids get nowt.

all this internet myth about "restoring to as new" , "second hand parts cant be used" is bullshit.

David I dint say new what I ment was original as befor the accsident, and I have been autherised to use second hand bumers to save cars from being wrote off. No one insurance company and assessor is the same and can approch jobs differantly and are open to discushon. Mate ive only been doing the job 40 year

They're the words I was trying to think of:doh No way would I trust the Mark 1 eyeball to judge whether a car is in or out of alignment. It has to go on the the proper equipment, Dave. If it checks out ok and doors are readjusted to open and close properly, drive it on until it stops. At the end of the day, nobody apparently seriously hurt, it's a good result. If the car is ok chassis wise, no point nit picking over a minor scratch here and there as they don't effect how it drives, which is the important bit. Bottom line, if the repairs make the car roadworthy and street legal, there's not a lot to complain about.

Someone is taking the piss bigtime here, theres no way Direct Line would endorse this kind of rubbish, its beyond belief???

Pick that phone up and start screaming now.......I cannot see ANY insurer allowing something like this?????????????????
 
As I said in a much earlier post, if you are in the AA or RAC, get their legal department involved for the price of a phone call.... if that..:thumb2

yup, exactly, I was surprised at this, but apaprently Direct Line have taken the hump wth Peter because he hasnt accepted the repair, so I dunno whats going on..!!! im just glad i have taken the photos, because I suspect they may come in handy, although there are two new assessors due to look at the car...

Well I swear Clive if you hadn't seen it and photograhed it I'd have said you were off your trolley! LOL

I'm struggling to see what DLs problem would be here given the unarguable conclusion that this is a no-fault claim....the other party is 100% responsible for putting Pete back as he was before the accident.....and this all sounds too amateurish to be DL in my experience (or any major insurer come to that!)? I've had a no-fault write-off with them and they couldn't have been more professional, I just find it gobsmackingly weird....

I mean if the other party is with them as well it might start to explain things but that looks the sort of work that a Calcutta garage would do, it just doesn't make any sense at all??
 
From the few facts this thread has presented, and having only seen the "after" photo's, i am thinking the OP needs to stop messing around and involve Trading Standards (and seek some free advice from CAB or similar) and possibly pay for a professional enginneers report on the current state of the vehicle right away.
 
update

just had a phone call from direct line claims dept .

they are sending out a independant assesor ( from rbs ) within the next 7 days to examine my vehicle .

Briggie if I lived closer I'd come and have a look myself unless of course we could meet half way with your T2. Right then I know this wont help you but set the record straight.

I spoke to an assessor today his answer was " to save a car from being beyond economical repair (wrote off) he would authorise a contract price repair". What this means is, lets say for example the contract price was £900, that 900 would include paint parts labour and sundries, the garage would have to leaise with the customer how that 900 was spent, so after labour had been agreed what was left would go paint, parts new, spurious, or second hand. If the garage and customer couldnt agree the garage dont do the work and the bloke still has a bent car.

Nor was it made up , i used info from a mate who is a very senior claims manager for a household name insurer and my own car repair. the advice to briggie remains the same as posted then ............negotiate ;)
 
thanks guys for your comments , im really not happy about the condition of my car ,what you cant see in those pics is the rear cross member is badly dented , bumper is tied on with cable ties , most doors are out of alignment , the exception being the passengers door ( i think ) .

it looked a heck of a lot worse than that after the accident , and its obvious that despite their comments that a new bumper would be supplied , that does not appear to be what they where doing.

im no expert , but to me its obvious the chassis is twisted and the body shell too, and i refuse to drive it in that condition bearng in mind i often take my grandkids in it .

my point is surely im entitled to have my car back in the same condition ( or better ) than it was before the accident , which has allready been admitted wasnt my fault ?

this car was in excellent condition before the accident as many people will testify .

its a bluddie wreck at the mo and i will not allow it to be bodged , am i right ?

In my experience the situation is pretty straight forward if you are fully comprehensive on your cover then the car will either be repaired or if its beyond economic repair they will pay market value for the vehicle so you can buy a replacement.

Your insurance company will usually pay you out on a knock for knock basis so if its not your fault you do not loose any N.C.B. If you are on third party cover then its a matter of persuing the other party's insurers.

Last time I had a similar situation about 15 years ago my Carlton was stolen and involved in a Police chase wherupon it sustained some minor damage but before the vehicle was recovered the dash was stolen out of it complete with all the instruments with a scaffolded steering column to defeat the column lock.

I was gutted as I had just had a cambelt change with some new engine electronics, four new tyres, new rear self levelling type shockers at the rear having spent around £1600 in new parts on it with a view to keeping it another 2 years. My insurers offered me £2000 for the car. I declined the offer and negociated to buy the salvage for £500 and was met with lots of resistance and fobbing off as they stated they did not do deals over salvage as it was contracted out.

I wrote to the Insurers saying I would pay £500 for the salvage and accept £1500 from them in final settlement. The loss adjusters and the underwriters accepted my offer. I bought used parts from Allvox breakers for £200 spent a couple of days fitting the dash. Paid £75 for an engineers Inspection & Report together with a new MoT and they re-insured the vehicle about a month later. I ran it for 3 years and sold it to my Brother who ran it for another 3 years. When he traded it in it had 225 k miles on the clock.

There is no obligation for anyone to repair your vehicle to its former glory if the cost of the repairs is uneconomic you just get maket value. I am pretty certain that they have to use new parts be they Nissan or Pattern parts where available. One of the reasons imports are more expensive to insure is the cost of bits even when they are the same as UK spec vehicles.

Just make sure that you do not have to foot the bill for an independent assessor if he does not find in your favour.
I had this issue with Saga when my Mini was vandalised 2-3 years ago and had the radio/CD stolen from it. I was OK as it turned out as the Independent Assessor found in my favour against my insurers in a dispute over consequential damage where they would not give instructions for the full repairs claiming the vehicle was previously damaged.

A lot of good advise given already.
The point of my post is with regard to the miss alignment of the doors.
impact force was enough to move the doors on there mounts ,
remember they are only bolted on.
i would have a GOOD look at the chassis if its bent/buckled there maybe cracked paint ,under seal ,rippled floor pan. look for any bolts that connect chassis to body have they moved. if any are found get out the camera.:sly.
