just sold my gf's blackberry storm, and the buyers trying to pull a fast one, giving it the phone dosent work blah blah, and they want a refund, so i'm now waiting for them to send it back!

Has anyone had this sort of thing happen?

I have heard about scams where people buy stuff swap bits or break it and send it back as faulty.

If they paid via Paypal then you are stuffed as they will complain and get refunded.

Make sure they have checked everything and you're clear about whats not working. Is it dead? Have they removed and replaced the battery? Can they not get a signal? etc.. etc.. That might decide the next step.

But if it IS knakd, make them ship it back for inspection before you issue a refund and get a clear statement from them as you might need to claim on the shipper if its been damaged.

Can you post the link to the auction and we'll have a butchers at the buyer?

ebay is killing itself, well paypal part of ebay is killing ebay

but why not try it on someone else buy a winch or something. paypal the payment then collect it, dont get it posted. then when you get home cancel the paypal payment....

simple really they base everything on the seller proving the item has been delivered ... if you collect they cant and wont have your address to persue you. if your clever you will have changed your ebay contact details by then.

im sick of ebay i try not to sell there any more. if i do its wheels or something then its cash on collection

a new winch will save you 250-300 quid and all of a sudden your a winner

im down roughly 400.00 on paypal paymet refunds . so sod them ill have a winch . and ebay / paypal can rot
 
My missus nearly got robbed last night - bid up a poxy (and frankly hideous) gothic-look TV cabinet from £50 to £126 and won it. Then noticed (she's only just started doing it herself!) that (i) it was a private auction (for a bloody TV cabinet?), and (ii) when she mailed eBay about potential shilling they told her the only other bidder had only been registered for 24 hours....how convenient...and the seller mailed her immediately to ask when she was bringing the cash round.

I dictated her a polite mail which said, let me think, oh yes. "F*CK OFF"..and she never heard a thing back!....
 
i guess at 250.00 you sent it recorded delivery. so have tracking details and insurance
not sure how you would stand with paypal on damaged / faulty goods . but id guess you will loose
 
think i will get it maybe tomorrow, then put in th eroyal mail paperwork, have to give the refund, hopefuly get the insurance back, and because th estorm is still under contract, (vodaphone dont know we sold it) change it for a working one. bugger

change your ebay details, because if ebay find in his favour and you dont refund him they WILL deduct it from you account, there was a guy on our local radio station who sold a laptop for his son, and 43 days later complained to ebay that it did'nt work, ebay found in his favour, but the seller did'nt go into his account for a few weeks after the sale, when he recieved his BANK statement pay pal had taken the money back. i know some of you will say they can't do that, i know they can't. but they did and thats why it was on the radio, and is going to court, i hav'nt heard the out come as yet. :eek:

that only works if you linked your paypal to your bank account. mine is not any more but im -39 quid on one account but the address is something stupid all due to refunds

true ebay sucks now, you just got to play the game there way so it works for you.

free winch dont sound too bad though does it
 
are they just doing somethign wrong, is it sim locked and they have the wrong sim? it could be a genuine mistake or mix up, look on the bright side before you start worrying too much :thumbs
 
Hard to tell with the sellers history - he's just sold a brand new Nokia N70 which is only a six month old model, plus he has one bad feedback from a buyer saying 'he sells fakes'. Also seems to buy a fair few 'tech' items.

But dsg, what did he tell you was wrong with it???? Do tell? I take it from your post he's already shipped it back....if its damaged get photos and anything else you can. If his packaging was inadequate photograph that as well. Make them available to Paypal if it comes to a discussion.

If you can prove it works, Paypal cannot legally deduct the money as you have a contract with the seller - thats an inescapable legal fact that they cannot overturn. If theres been offer (the auction) and acceptance (his bid) and you've supplied goods fit for purpose, then its a closed issue and you should threaten to sue PP in the small claims court for your money if they refund the buyer...it costs you £25 and its easy (you can do it online) and for PP its a waste of money - it would cost them more to send someone to the hearing (which is informal in front of a minor judge and not overwhelming) so they'd almost certainly cave in. Trust me I've done it elsewhere numerous times.

But it all depends on what the buyer said was wrong and what you find when you open the package...
 
Firstly this site is well worth its weight in gold, as are you guys.

when he recieved the phone he said it would not turn on, after i told him to quickly press and not hold down the power button it came on, than he said the screen was fuzzy, and at the same time opened a dispute. nob.

I cannot un-link my bank account as the account is held at -£249.00. so i assume thay have deducted it from my account? as it was £0, but when i sold the phone it was +£250 so i bought the now one for her cost ing £250 taking the balance back to £0, now with the dispute its -£249.?

The buyer said the box and packaging was perfect, when i asked for him to send it all back, so i could give it to the post office to asses he said he got it at work and binned the wrapper, but i sent it to his home address?

Sorry to hear about this and that twat , youre in a bloody awful position, I was in dispute with a knock on wood bonce a few weeks back, ebay are a pain at times.

Couple of points though.

I've sold electronics on there and as each had an identifying label fixed (home made and signed if needs be) preventing tampering plus no seal means no return, theyre stuffed for swap and return. As a nearly new blackberry will have this either from manf or you you'll be able to tell once it comes back, very very strong case for you. May take time to knock on wood with paypal/ebay but theres no reason why you wont get there.

For future ref dont ever use id hidden unless its perv or porn your peddling. That way anyone researching anything they dont like the look of can follow up to a greater degree :thumb2

the phone does have an imei number for the handset, so as you say if anything is missing i should ba able to tell, it does seem very buyer heavy. even though he has the phone and his cash back.

they can't give him his money back until you've got the goods....!

I thought that was the rule too but I dont know.

When numpty head launched his complaint against me ebay didnt take any money or anything they told us "to talk" then if it wasnt resolved in x time they would intervene.

ebay is for buyers now, not sellers. its badly biased towards the buyer. if he complains, they will take the cash off you while they investigate. Its very very bad, and didnt used to be this way. look, best thing to do form now is DO NOT accept paypal any more. never mind the inconvenience of cashing a cheque, its way more inconvenient if paypal start screwing around, and they will.

This guy sells phones, so he knows how they work, so he HAS to return it to you, so i hoep you hav etold him so via email. Once back withyou, you can verify his claim, and mail him. send all these emaisl to paypal investigation. see what happens.

hi guys

well i recieved th ephone back this morning, no memory card, scratched and it works?

so i rang pappal, was on hold and a menu system for 10 mins (not to bad) spoke to 2 europeans and a claims advisor who said:

"even if the buyer returned an empty box pay pal would refund the buyer and you (the seller) would have to file a claim, well thanks a bunch i said, so i escalated it and banged a claim straight in.

so he will get his refund and i'm left with a semi duff phone and probably weeks of arsing around and a mark against my name.
