do they get money back through pay pal, how does that work with you? i think its pretty bad that pay pal can just refund whilst an "investigation" is in progress...

If you cannot prove the items have been delivered paypal will ALWAYS side with the buyer.

If they say goods are unfit etc they have to return them in a recorded manner otherwise paypal will side with you.

if the goods are faulty you MUST refund the full ammount plus the return postage.

Trouble is , Define faulty.

I know its a painful situation, but as a business seller, the law makes it your responsibility to ensure the goods get delivered, as the contract obviously isn't complete until thats happened. Either that or swallow the cost when someone acts the goat like this. Just the joys of doing business unfortunately :(:(

I have to admit I do get pi$$ed off with sellers who say its not their responsibility if items are lost in the post but they will provide a PoP if you need it for a claim. I report every one of them I see...:augie
 
Yup, correct. The consignor (sender) has the obligation to get the stuff to the consignee (potential recipient). Whatever courier or delivery company they choose is up to them and irrelevant to consignee as the consignors obligations arent fulfilled until the cosignee gets there hands on it.

We've had several jobs in the past where goods have been left with a neighbour who subsequently deny they've taken them in and surprise surprise the delivery note is signed by M Mouse at number 52 in a 50 house street :doh

On more than one occasion the parcel company have denied all liability and said they delivered................... WRONG egg on face.

They are in breach of contract by not delivering it to the correct person or taking reasonable steps to ensure that is done to the best of their ability. The last bit covers them more for multi occupancy premises.

I didnt know all of this until a nice chap from the Royal Mail Investigations explained it all :thumb2


So come on Darwin, get it sorted before he sues :augie:augie
 
Superb delivery from one ebayer and the Post office today,

Bought a vent wall plate yesterday morning, his listing said posts within 2 working days ,the postie shoved it through the door (just :D ) this afternoon.

Excellent service :clap:clap:clap
