This a retorical question Rick, But I'm assuming whatever you've built is on residential land as opposed to agricultural? I'm just not clear if/how the 10-year rule applies in such cases.
 
The basis of the 4-year rule is that it stops a planning authority taking planning enforcement action against the alleged unauthorised development if it has been continuously in use for 4 years or more as a seperate dwelling.

and the ten year rule applies to change of use - a situation where agricultural land has been used for something else without PP....so if whatever Ricks done is on residential land then the four year rule is fine, if not, discretion might be required.:augie

OK to clarify, we have lived on agri land for 8 years in a mobile home, and the council have been tying to remove us from that time, but there are ways and means and we are still here, but 4 years ago I learnt of the 4 year rule re converting an existing building to full living accommodation, so converted the stables completing and moving in on the 7 March 4 years ago with all the evidence needed to prove this, so that is why we are celebrating, we have won and lost some battles during this time but have now won the war.

Now to make this easier on me YOU ARE ALL INVITED but you must PM me for the date and address, last thing I want is Gate Crashers, but Swifty will sort any problems he is renowned for it, best regards Rick

Well I'm sure you've already done it Rick, but if not, check with a specialist solicitor, because my understanding of the process is that its a ten year rule as regards change of use of land (from agri to residential) and while the four year rule may mean you get away with the building staying up, you might not be able to legally occupy it. But I'm sure you've done your homework so well done whatever!:thumb2

Yes done my homework very thoroughly 4 year rule applies to converted "existing" buildings , and as "Thurrock" council found to their cost you do not have to have lived in it without interruption for the 4 years , you are entitled to have "holidays", Rick
