So can the person or people blocking the rights of way be prosecuted :confused:


I may get my numbers wrong but the council should serve then notice under section H130B - they then have so long, 2 or 4 weeks can't remember to comply. If they don't the council can then take them to court over it.

It is possible to force the hand of the council by serving them notice under H130A to get it cleared, they then do the above but have approx double the time frame to do it before you can take them to court - should never get to that last stage though.
 
prow officer chat

just spoke to the prow officer responsible for the area that the lane is situated in.
right, there is no restriction on this lane, he said it should be open to motor vehicles and will send down an inspection team to look for this monster bit of concrete and try to find out who put it there.
so i got a result!
just have to wait and be patient now i guess!
 
dont want to push my luck so i will give it a week and then try again to see if the obstruction has gone.
The prow officer seemed to be a very reasonable guy, even gave me info on where to see closures and restriction on the local gov website

well just tried his web link and its just a question annd answer thingy, that points to a "definative map", strangly enough this doesnt seem to be downloadable and you have to visit the county council by appointment to view it!

standard practice I'm afraid but well worth it to know if you are definitely in the right on a given route, just in case any interested parties try to persuade you you're trespassing!:)

they are still there, i will be getting onto the prow officer again tommorow and see whats going on.

how much weight can your hiab lift?
this block of concrete has hooks on it and is approx 1m cubed so must be really heavy, but to get to it you will have to reverse through some over grown tree branches.
dont want to hurt your truck!

Wont hurt the lorry & makes 'extreme-4x4's' ground Clarence look low :eek: :lol

HIAB will lift 10 tonne fully extended & a shade over 17 tonne non extended :thumbs

Concrete block should be under 5 tonne :thumbs
