You have to be realistic on this one sadly.
Sheila was a bit at fault for paying the cheque into the wrong account.
The Collections company is not at fault in any way at all and you are dependant on their coperation in getting it back.
The bank, however, while not deliberately negligent, is technically negligent for taking a crossed cheque into another account.....but even thats a bit of a grey area these days in that while you would prevail eventually, it would take time, effort and money.
Difficult.
sheila admits her mistake and feels awfull , but my point is , the cheque was made payable to her , and not the company , and im sure it wont have been crossed or made payable to anyone else , but we wait and see

I would have thought 10/10 100% but it may take a while.
Will the bank give you a free overdraft for part of this to tide you over until the error is corrected?:nenau
