i hate cheques,cash is only way to go,if u lose it go out earn more simplze that way!
 
tried that ...... they are looking into my request and investigating ...... even though i explained that they had the money fraudulently in my opinion

You have to be realistic on this one sadly.

Sheila was a bit at fault for paying the cheque into the wrong account.

The Collections company is not at fault in any way at all and you are dependant on their coperation in getting it back.

The bank, however, while not deliberately negligent, is technically negligent for taking a crossed cheque into another account.....but even thats a bit of a grey area these days in that while you would prevail eventually, it would take time, effort and money.

yes but the company doesn't know that does it, as far as its concerned its just received a larger payment than normal thank you very much.

It would have been crossed - all cheques are nowadays - and cheques can't be endorsed to anyone else these days either, so thats why I say that technically the bank was at fault for accepting it into the wrong account. But getting them to fix that is another can of worms.

The trouble is, for example, that despite the fact cheques cannot be endorsed any more, these cheque cashing shops still take them into their accounts for people....technically that beaks the rules but the banks would seem to allow it and until theres an objection from the original payee (which there shouldn't be) they won't make a fuss about it.

Impossible to say....I mean your first port of call would be the collections company which is where the bank will point you anyway in an effort to avoid having to do owt. Just have to keep the pressure up.
 
your bank is there to protect you. they shoudl be able to reverse what has happened, and in the course of investigation they should contact the collections company, explain, and take themoney back. besides, i thought it took afew days to cash a cheque?
 
i cant believe you could get shafted on this one,on a plus side have they reduced the bill amount by the amount on cheque? and can u aford to live until next payday? cloud/silver lining kindve thing?

it was a MONTHS wage for sheila .... so certainly not a insignificant amount , strangely enough the collection company havent actually admitted to recieving it :augie , as for living untill next month ...... of course we can , but sacrifices will have to be made obviously

I would have thought 10/10 100% but it may take a while.

Will the bank give you a free overdraft for part of this to tide you over until the error is corrected?:nenau

er no , they are in fact charging me for a unauthorised overdraft :eek:
 
Sorry you have 'lost' the money but it will come back... My bank RBS have said that the UK cheque guarantee scheme is closing on the 30th june 2011, which I presume means the end of
cheques! could cause a lot of problems, regards bri

I have had a letter like this from halifax bank last week, will make my life easier as most of my customers like to pay by cheque which then means they have to wait for it to clear into my account before i do any work for them, on another note i am sure you will get your money back briggie and any charges should be refunded
