But remembered Briggie`s thread regarding Sheila`s Disco mot failure so I rang my mot test centre and asked the question and they directed me to this site.
what you lot recon. JUST READ BELOW THE zzzzzzzzzzzzzzzzzzs.

A friend of mine maintains that if you have a car MOT Tested before the expiry date she will have 2 weeks in which to repair / drive it before it is illegal. I am under the understanding that once the MOT has expired you are not permitted to drive at all unless going to and from a place of repair (MOT Garage or otherwise). Please can you clairfy the correct and legal thing to do. Many Thanks, Dan Clark

Your MOT is valid until its expiry date even if in the meantime your car fails the MOT - the original pass is still valid. In fact you can have the Test done up to a calendar month before the expiry date and have the new MOT forward-dated to the expiry date of the existing certificate. So if you have your car Tested during that month and it fails, this gives you time to have the repairs carried out and the car re-tested before the expiry of the original certificate and you are not disadvantaged as a result. - MOTT.

But its still a technicality...yes you won't get done for an expired MoT because the other ones remains valid. But depending on the reason(s) for failure, you stand to get done for driving an unroadworthy vehicle. And because the MoT fail will also be recorded on the DVLA database, you would be picked up for a stop by ANPR. :(

I think I agree with the Luvgluv on this:eek: It's double jeopardy as one can always be done for an unroadworthy car, but if it's on some data base in plod land then the dreaded ANPR will pick you up too :doh

I know what you mean that the MOT cert can be valid to a certain date, and that one can early book it and so get 13 months ticket etc. However if you fail the mot test in month 11 then by defenition the car is not roadworthy:confused:
I assume it's trying to let you drive home post mot fail to fix it up , but you try telling PC "I've got a target to meet" Plod that and see what happens:nenau
Once again the law is an ass:thumbs

No discrepancy.....all it means is, as I said above, that you don't commit the technical offence of not having a valid MoT certificate. But thats all.
If you fail the early MoT because, say, of structural rust, or defective brakes etc.. then your vehicle is unroadworthy and illegal to drive. And because the MoT fail is logged on the DVLA system (together with your current certificate), it will be picked up by an ANPR camera, so you stand an excellent chance of being caught.

looks like best thing to do then is get them to do an mot without using proper documentation (back of a fag packet or such)then if it fails there wont be a record except park drive tipped.:doh

just to add to this ...... sheilas car failed the test mainly due to " excessive corrosion " on the inner wings , boot floor and such like , so by the definition posted in here of unroadworthy vehicle ..... id say that applies in the case of sheilas ( ex ) disco

correct as a stand-alone statement.
just to add to this ...... Sheilas car failed the test mainly due to " excessive corrosion " on the inner wings , boot floor and such like , so by the definition posted in here of unroadworthy vehicle ..... Id say that applies in the case of sheilas ( ex ) disco

MOT fail means your vehicle has failed to meet some very very basic requirements to make it safe on the road.
Therfore anyone who continues using after that point is an arse. The get to repair clause is at the testers decision its not your automatic right, they can ground the car there and then if they want

One in paricular argued it had been a minor fail and went to court. The court held the view that a fail is a fail and in the opinion of a qulified expert ie the tester the vehicle should not have been on the road.
Quite rightly the accused was hit with all costs and a fine.
Result, one less proven unroadworthy vehicle on the road.
That's the way it is guys.

think disco will be ok just needs service had new window screen fitted due to crack.
might need jet washing underneath though seems to have picked up some mud from somewhere.:augion the web site

Your vehicle can fail an MoT test if the screenwashers do not work - on a cloudless sunny day - hardly a major safety issue - not much difference between this and this last winter when your pipes & jets are frozen solid.

Absolutely correct, hardly a credible example though :naughty
However if you want to develop the point....................
A flock of pigeons out enjoying a trip through the clear blue sky have a crap on your windscreen , you smear it all over the place trying to clean it off. Because of that and with the sun in your eyes you fail to see the black dog leaping out in front of you so as you hit it and brake hard in reaction your twin axle caravan jackknifes and wipes out the group of social workers waiting at the pelican crossing with the group of 40 disadvantaged children.
All because your washers didnt work :nono:nono
Stupid scenario I know but so's suggesting the average Joe would end up in court over window washers :naughty
I can assure you discretion remains and the example I cite was significantly further down the line than frozen or u/s windscreen washers. Be prepared to deal with the worst and deal sympathetically with the lesser problem ;)
on one them road wars type programmes the copper had a right isue with washers,like he said if u cant see your an acident waitin to happen!
