As you have had a loss due to some else's negligence then you should have a cast iron case through the courts.
Do you have legal cover on your house insurance? if you do give them a ring Some years ago a local kid on his way to school kicked a stone, it bounced off the kerb and broke on of my house windows. Small claims court sorted it, negligence said the judge, Small claims can be up to around £10,000 or more, cost you a % of the claim, no lawyers, just you and the negligent one, if you are successful ask the judge to escalate it to the high court, pay £60 to get the sheriffs to handle it. Look for 'The sheriffs are coming' on YouTube. I saw it on BBC, no messing with those guys. If the cops are prosecuting the driver wait until there is a verdict, if guilty the driver stands no chance in a civil court. Is the driver has admitted guilt then no contest. Hill Street Blues style, 'do it to them before they do it to you'. |
