Lost supension?

Just looking for a bit of advice here guys.

As some of you will know I'm upgrading my suspension setup and bought a setup from Aus.

This was sent out in June and without looking properly for exact dates, it was due to be delivered on the 5th July.

Tnt were sending it and time passed with it no-where to be seen. As it turned out tnt had no idea both at this end and at Aus end where the hell this was. No idea at all and this was Aus company hounding them. They told me if it wasn't accounted for by 30 days they would get insurance as I paid for insurance luckily.

Company put in a claim for missing freight and set about getting me a new updated and upgraded setup and posted that out for me.

Just as they sent it guess what turns up out the blue: original order and now tax bill for it.

Can I refuse to pay that tax on the grounds that it was lost, (they can take it away and destroy it for all I care) as I'm not wanting to pay 2 lots of tax bills?
