I am installing a Wireless IP camera into my home afetr my neighbours son threatened me (im not sure, but i think his threat was to remove my car from the shared drive himself, or perhaps his threat was to get violent?) either way, I want a camera for protection. ive ordered a simple and cheap wireless IP camera from ebay (we already have one inside the garage to monitor our pets).

Im wondering about position, and what I can/cannot view using the camera. I wish, initially, to point it at my front drive where my cars go. this overlooks the street, and may include the shared drive. does this sound acceptable, law wise? all I will be able to see on the camera is what I can see anyway when I look out my front window from the top floor. I am not interested in the neighbours gardens etc, just my property.

as for recording, it will be motion activated and will upload images to a website for me, something like that.

what you think?

i think you will find you can only monitor your own property, and not any neighbouring homes, driveway and vehicles should be ok, you could always phone the police, or daved may know more.

you are perfectly entitled to record in a public place , the definition of which is a place accesable by the public , if in doubt apply a sign or sticker warning that cctv and recording is taking place and if people choose to ignore the warning they are effectively giving their consent to be recorded

There are some issues you need to consider if installing any kind of personal CCTV system. Cameras should only be pointed at your own property - you don't want to be accused of spying on other people. The current advice is that you should not be deliberately viewing areas outside your own property's boundary unless it is unavoidable. Human Rights legislation concerning the individual's right to privacy means that passers by might complain about being 'spied' upon by your camera and appoint a solicitor to effect a Civil Action against you.

Users of small systems or home systems which contain less than 3 cameras, which are not remotely operated i.e. they cannot be moved left/right and zoomed from a controller away from the camera, and the information gathered is passed to no-one but the Police, have no requirement to register with the UK Information Commissioner (Data Protection Act 1998), nor place signs, keep tape records etc although placing signage can assist as a deterrent.

well, i should be ok then, i am hoping to monitor the "shared drive" also, so that if my neighbours son decides he wants to damge my property by dragging it off the drive/over the drive, i have him on camera and i can have him for criminal damage both to my property, and the drive. ive put up a stick "cctv 24 hour recording in operation" and this is displayed on my side window (dormer window) so faces the door but visible from the street.

this is purely defensive, i've got real troubles with my nerves, and being threatened has undone all my hard work in sorting myself out. my weights dropped, im sleeping badly and im on edge.

It's a very grey area so air on the side of caution. At the end of the day you are entitled to take video and stills in a public place which is how google did it. Think your self lucky you don't live in France as it is technically illegal to take a photo in a public place, due to copyrights in the background such as buildings.

I think your problem area is the shared drive area and who owns it. That will be your sticking point with the CCTV.

well, the camera i have can move almost 360, so can easily view the street, neighbours and so on BUT I will only have it pointed at my drive and possibly the shared drive. thing is, the shared drive belongs to us both, so id have thought legally, I can point my camera at it, or at least half of it! what do you think??

it will only alarm record, so recording isnt constant but i will monitor it all the time. i will only have the one camera and i will place it in my top bedroom window pointing down, sure, it may catch some street etc, and that IS unavoidable, but I have a sticker in my living room window, clearly visible if you look.

i shoudl have it in a few days, ill post some pics so you can see if ive got it right!
