Parking ticket dispute...

On and off parked here for the last 5 years to occasionally walk the mrs dog, so not to block the road up I sometimes put who wheels on the grass which is the land of the park (I believe) came back this morning with a ticket slapped on my screen...

So wanted opinions, what do you guys think.

Yep they have you !
TBH not worth ever parking with nearside wheels on the pavement or verge.
The road is plenty wide enough so why risk it ?

looks like you're banged to rights. I wish they were as keen as this for cars that park on cyclepaths.

you mounted the kerb, that is illegal for any purpose, the kerb marks the limit of the road and you went off it, there are hundreds of laws like this routinely broken and for the most part are ignored, so in future sod the traffic you will cause inconvenience to and only park on the road, I think very seriously about mounting the kerb to say let an ambulance through as I know if there was an officious traffic warden about he could ticket me and if I went to court and said I did it purely to let the emergency vehicle through, the judge would say it is not a valid reason, just like if you are at a red light and two and blues were behind you, you must not go through that light if there are signal cameras you will be done, Rick

No comment, don't know the bylaws for your district.
You need to take this up with the department that issued it, show the photographs.
If you drive around any estate in the country, you will see cars parked that way even on the footpath.
Never heard of any tickets being issued... But I wish they were...

I might make a copy of that and fill in some details to frighten my neighbours friends from blocking the pavements.

I always thought contravention 62 was having inappropriate bumpers on a vehicle lol...

When driving a artic a long while ago we had to reverse into a very tight gateway, opposite was a house fronting the pavement, with an old biddy sat at the window if the front wheel went up the kerb by half an inch she would be on the phone to plod and they would attend every time, fortunately for me I was forewarned on my first visit or I would have earned a ticket, Rick

These days the police won't attend breakins, doubt they will attend two wheels on a curb for a second, with no evidence of the offence.

I don't know, I've been watching those Traffic/Motorway Cops on the tellybox and they seem pretty keen to nick all sorts.

Seem a very high fine, there are limits that They can fine you for different types of offence. Check the the fine fits the crime.
Also I have asked CEOS in our area to ticket cars that park on the path reducing the space for wheel chairs n kids. They told me as a CEO they are not permitted to issue tickets for obstruction or yellow lines. I would check with the parking office to see if the CER was permitted to actually issue that ticket if not it could be invalid.
I would ask a fee questions but pay the reduce amount and contest it in good time.

The Traffic Management Act 2004 came in after I retired and I believe various local authorities can adopt the whole or part of the act for enforcement. Seems a tad arbritrary to me.

Before that it was only an offence for a HGV to park on the pavement. To prosecute a car driver you had to prove an obstruction and prior to 2003 it was not a fixed penalty offence.

I assume it has not been adopted in the Derby City Area as two thirds of the vehicles parked near me are with nearside wheels on the pavement.

Highway code rule 244 states You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it, Rick

The Highway Code does not create enforcable offences for which you can be prosecuted it's just what it says a Code for drivers though some of its parts are enacted in specific legislation elsewhere.

True the highway code is just as it says on the cover a code meaning a code of conduct and means nothing in law.

On the other hand I can see Alexs wheels on a grass verge not a pavement, there is a clear pavement on the other side of the road.

Have to say I would be tempted to fight it but then again I think it says £55, so may be less stressful to pay it and move on because you dont gets points or a criminal record from this.
