Even though I sent pictures of the item that I wanted and paid 2 months they still havent managed to get me the correct part.

says they have sent it and then say they havent , say they will give refund and dont , say they will refund my return postage and dont.

SCUM , stay away.

I will be posting this on every 4x4 forum I can find until the send the correct part or refund my cash.

I phoned up today and they agreed to a refund , I sent a paypal refund request and they cancelled it:rolleyes:

Not teaching me granny to suck eggs D but surely if you've raised a Paypal case and said you haven't had delivery and have had to source the part elsewhere you'll get your mone refunded won't you?

I've had to do it several times and never had a problem?

I cant claim via paypal because they sent the wrong item and they can send tracking details

filled out small claims docs but can do it till payday , thursday.

Still don't get it - wrong bit, contract not completed...no brainer.

Tracking is irrelevant.

But I'm assuming your paypal deadline has run out? If it isn't, you need to be clear that Paypal has exactly the same responsibility as your card issuer would have had if they had paid the supplier.

You should be able to cancel with either because the supplier has taken your money against an incompleted contract, with sufficient time passed to justify you having gone somewhere else for the bit...?

Have you tried your card issuer, although I suspect the fact they paid Paypal technically gets them off the hook?

I sent a bailiff into Barclays Head Office once for failing to pay a county court judgement for the return of credit card charges.

So either bailiff or winding up order in this case , tbh depends on how much more attitude I get from them.

gotta put a claim in for loss of earnings and expenses.

trading standards all the way:thumb2 I had similar problem and when trading standards got involved it was sorted in 10 days.

They do ask that you have put the issue in writing to the company before they get involved, which i did - an email would do.

Hope you get this sorted.

Courts can be a bit strange with costs, the fine should always be higher than the costs, as the fine is the punishment not the costs. I take a number of cases out through work and depended upon the Judge/presiding Magistrate they will amend cost applications:(, mainly we do get higher costs:) but only if they are not massively more than the fine (upto about £2k but we are talking about fines of thoasands)

pester the local trading standards, they have a duty to enforce their legislation no matter how minor. there is a whole suite of actions they can take from a warning letter through prosecution to complete closure. if they won't action anything make a formal complaint to the ts about their conduct.
