ok guys firstly thank you for the warm welcome.
so on to the motor bought it for a grand mot PASSED on the 19 may. bought it to replace my espace that i refuse to spend any more money on.
so im told before i start my 3.5 hour train journy that the car is fine other than the vibration at 50 to 70.

sadly after advise from you guys i went underneath to check play in the prop and found this.

now i know im to blame for not checking it over a i bought it but it was shiny and sounded sweet.
but surely with holes like that it should not have passed an mot two weeks ago.
fixed the bits and bobs inside and found the rear tyre's are cracked all the way around so get them done tomorrow.

That should not have passed an MOT 2 weeks ago, Sounds like a dodgy MOT.
Did you buy it trade or private?
Leaking sunroof isn't really a problem.

If bought privately phone them and explain your problems. You never know they might offer you your money back. If no joy you then phone the mot station to see what they can do. They're not going to want to be inspected so you should get this resolved.
If bought from a trader there's a good chance they're either the mot station too or they are pals with them so you should get somewhere.
Take a video starting with the reg no and then straight to the rot. There's no excuses then.
If you're offered your money back plus compensation for your trouble/expenses you'll probably lose the truck but to be honest that wouldn't be a bad thing, would it?
Obviously don't spend a penny on it. :(
It's a shame but there there'll be others for sale.

Might be worth keeping any adverts you saw for it, they can be slow taking them down if online. Just incase things get a little sticky. They said, you said can be hard to prove, but if an advert is worded to deliberately mislead (blatantly lie) then useful to have.
Not sure how these thing work but something I would do myself.

Looks as though you have been done over.
I would look to get my money back and if no joy make a complaint to VOSA about the dodgy MoT assuming its not a computer generated fake.

OMG do not drive it! That's the chassis. This needs reporting to the authorities that should not of had an mot for several years. Seriously mate You need to report this, in my opinion it is life threatening to drive that on the roads. Think of what would of happened if you had your family in there and you had an accident.
Personally I wouldn't be going back to the seller or mot station, I would go straight to the authorities on this one. I have only seen one other vehicle on here anywhere near as bad.
Good look and try and think of the cost of a life not the money you paid.
Just had a look at the first picture showing the side of the car, you can see the drivers door is out of alignment. The truck is literally folding in half.
Please update us as this progresses

Jeez even the MOT history looks really dodgy, spent nearly two years without an mot and then had two mots in 2015.

Hi,
Another thing I have seen people do is take it for another MOT as soon as possible. If you are stuck with it for while whist this is being sorted officially to get your money back it acts as a of record of condition on that day and date so the seller can't claim faults were down to your ware and tear / lack of care whilst you had it.
Be warned I do not know if the MOT station can stop you driving it home if they feel it is totally unsafe. Could be a good thing though as it removes any testers discretion from the equation.
A official vehicle inspection report would be better but will cost more now but if you need to get one later the faults on the MOT you had done will match his report therefore showing faults were there from start.
I am assuming here that you spent money that you do not want to lose and want to arm yourself with evidence to help you and your case if needed in the future.

An MOT station can and I think will slap a prohibition notice on the vehicle and stop it being driven on the roads.
Leave it parked up nice and safely and get it reported. I'm pretty sure you'll get your money back one way or another but may take some time.
Well guys bit of a turn around here. Got gumtree involved as it was on there site and the ad had been removed. With a bit of two and throwing and some not very nice words I've just received £800 back. Now the seller has said don't forget I've got the v5 and know here you live, my reply to this was" do you mean the one you let in the passenger foot well[emoji23] so yes I've got a rattley rotten truck but still have money for repairs ( I'll also hold off selling the espace [emoji30]) thanks for the advise guys I'll move to the mot test centre Monday

Get it reported straight to vosa don't risk driving it, it really is so dangerous in my opinion. These people need stopping before people get hurt or killed. They obviously didn't give a dam about yours or your families safety. Ring vosa on monday morning and don't let the seller have it back. If they try anything on get the police involved.
I doubt that will be a fixer

Pleased you got some money back they obviously knew it was an Iffy one.
report it to the police, he has directly threatened you so even if the police do nothing more than have a nice word, he will know youre not to be messed with either.
sorry to hear about the Terrano, as Jim has said, that is a serious liability and shouldn't be on the road - I suspect the front chassis mounts will be rotten and the rear above the fuel tank - get it checked over asap.
glad you got some money back, and maybe remind that guy you know where he lives too

Definitely get the seller and MOT tester reported, even if you have got your money back. I'll have a stab in the dark and say that this isn't the first unroadworthy car they've put on the road and won't be the last, unless.....

Like jim and don said, reporting the test station may well stop the same thing happening in the future, maybe save a life. It's an uncomfortable situation to be in, especially after what he said to you!
tbh i do agree mot tester i know has come to have alook this morning and said although the work is do able it should not have passed an mot in yearsand not to spend a penny on it till vosa have been to see it as it maybe taken away.
ill see what monday brings.

Have you looked at the price of Terrano parcel shelfs on ebay that is if you can find one rocking horse poop springs to mind. They always seem to go missing I guess because of the seven seats they get taken out and lost.

Sorry mate, was not fishing just suggesting that if they did take the car away for examination etc then keeping the parcel shelf could be a nice £70 ish in your pocket. Lots of Terrano's for sale do not have them in due I guess to them been lost through lack of use.

I just went off prices I have been quoted from parts websites and winning bids/classifieds on ebay and gumtree.
Our last 'walk in and remove yourself' breakers on the island has closed it's site. So now we are stuck with internet or waiting for trip over the water. Unless you get lucky at a yard before they crush the Terrano after removing engine,gearbox.

well all the VOSA/DVSA forms are sent off ill just wait for them to call me now ref one of their agents testing it. ill let you guys know when i hear then depending on what they say i may strip it.
so vosa have been in touch today and wanted me to drive to a test station about 10 mile away wednesday next week. when i said i wont drive it now ive seen how bad it is they arrange for a tech from the test station to come and have a look.
nopw its being picked up on a recovery truck on monday.

I have literallly just done a lovely law assesment (passed 75%+) on something very similar!
glad you got vosa involved, MOT stations do have prohabition orders for serrious defaults like yours. if the had put one on it, it should be in the history and cannot be legally removed by anyone other than a VOSA tester once the vehicle is properly repaired.
so its not a case of the owner(at time) taking it home on a truck, then selling it....because it wouldn't have a valid MOT.
Its a clear case of serious delict(neglect) on the MOT station's behalf. unfortunelty you would have a bit of a time sueing them, but the 3 things that fall under neglect are injuries, death and loss.
yours is technically an economic loss (money) as there has been no injuries caused but on the other hand you bought the motor in the good faith of the MOT certificate being proof of vehicle soundness which has caused you to loss the vehicle whch is loss of property, any insurance and tax paid. your still £200 buck out right?
I'd still push for VOSA to have the vehicle repaired at their expense by another garage as obviously you can't trust them and they'll probably loose their MOT license.
It can be repaired tho (mine's is being rebuilt) might take some doing and economically its not the easiest way.
Have you told VOSA about your refund from seller or shown them adverts?
If not you could claim the full cost from the MOT station less current scrap value as it should never have been MOT'd and you bought it in good faith that it was sound.

I was an MOT tester in the 70's and had a few disputes with customers, when the inspector that tested us visited, he always said have no fear we will back you all the way even if you are wrong, and upon relating this to the goods testing station manager who was in charge of our inspectors at the time he confirmed this, I met him socially as his wife was in the same hospital as my Mrs maternity ward, 1972 it was, Rick

vosa are keeping the car for the time being and the owner of the garage has offered to repair the truck or hand be back the remaining of the money to give me a full refund, that i have agreed to.not sure what will happen to the test station but ive since found out that the trader only uses them for his mots so barnsley beware.

Don't let that put you off mate, if you shop around and look every day there are some immaculate real bargains tio be had.
That's a very very uncommon occurance and certainly yours has to be one of the worst I'ver ever seen on the forum by a country mile so must have had the worst life ever in some horrible conditions.
Get another and I promise you wont be sad

Keep us updated with anymore info too. Are you allowed to say the name of mot station when the dust has settled?
Have to say though only ever seen one other truck reported on here as bad as that and funnily enough that too was a rogue mot from NI. You have had some really bad luck and believe us when we all say that it's very rare and the majority of terranos out there are fine, yes they'll have problems but normally minor.

I wouldn't be put off either, as said before my 97 plate has a really good chassis. There are plenty of good ones out there just got to get under them to check for rot.
